Terms of Service
These Terms of Service (the "Terms") govern your use of Eviction Navigator, including the website at www.housinglifelinellc.org and the software at app.housinglifelinellc.org (together, the "Service"), provided by Housing Lifeline LLC ("we," "us" or "our"). By creating an account or using the Service, you agree to these Terms.
1. What the Service is
Eviction Navigator is software that helps landlords and property managers organize rental information, follow eviction procedures, prepare documents, calculate dates and track cases. The Service provides general legal information and document preparation tools. It does not serve notices, file documents with any court or appear on your behalf.
2. Not a law firm; no legal advice
Housing Lifeline LLC is not a law firm and does not provide legal advice. No attorney-client relationship is created by your use of the Service. Information, plans, dates, documents and answers produced by the Service, including content generated with artificial intelligence, may be incomplete, out of date or incorrect, and laws and court procedures vary by location and change over time. You are responsible for reviewing all content, confirming requirements with the appropriate court or a licensed attorney, and deciding what to sign, serve and file. You should consult a licensed attorney for contested matters and any situation involving unusual facts.
3. Your account
You must provide accurate information, keep your login credentials confidential and notify us promptly of any unauthorized use. You are responsible for all activity under your account. You must be at least 18 years old and authorized to act for the properties you manage.
4. Your responsibilities and acceptable use
- You will use the Service only for lawful purposes and in compliance with all applicable landlord-tenant, fair housing, consumer protection, privacy and debt collection laws.
- You will not use the Service to harass, discriminate against or retaliate against any person, or to pursue any self-help eviction such as a lockout, utility shutoff or removal of a tenant's belongings.
- You are responsible for the accuracy of the information you enter and for having a lawful basis to collect and use your tenants' information.
- You will not attempt to interfere with, reverse engineer or gain unauthorized access to the Service.
5. Electronic signatures
When you sign a document electronically in the Service, you agree that your electronic signature has the same effect as your handwritten signature. Some courts require original handwritten or notarized signatures, and it is your responsibility to meet those requirements.
6. Fees
Fees, billing terms and any trial or refund terms are those stated in your order, plan or agreement with us. Court fees, service fees and other third-party costs are your responsibility.
7. Your content
You keep ownership of the information and documents you enter or create. You grant us a limited license to host, process and transmit that content solely to provide and support the Service. Our handling of personal information is described in our Privacy Policy.
8. No guarantee of outcome
We do not guarantee any result in any eviction or court proceeding, including that a notice, filing or date will be accepted by a court.
9. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST RENT, LOST PROFITS OR LOST DATA, ARISING FROM OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM.
11. Indemnification
You agree to defend, indemnify and hold harmless Housing Lifeline LLC and its officers, employees and agents from any claims, losses and expenses, including reasonable attorneys' fees, arising from your use of the Service, your content, or your violation of these Terms or of any law.
12. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or use the Service in a way that could harm others or the Service. Sections that by their nature should survive termination will survive.
13. Changes to the Service and these Terms
We may change the Service and these Terms from time to time. We will post updated Terms here and change the effective date above. Continued use after changes take effect means you accept the updated Terms.
